Any guest of our food tours acknowledges that the enjoyment and excitement of travel is derived in part from the inherent risks incurred by travel and activity beyond the accepted safety of life at home or work, and that these inherent risks contribute to such enjoyment and excitement, and are reasons for my voluntary participation. Therefore, the guest acknowledges that they are aware of the inherent hazards and risks associated with participating in a Big Mouth, LLC d/b/a Paris by Mouth (Paris by Mouth) tour, including those associated with travel, including walking, food/wine and adventure tours. Specifically, the guest is aware of the physical requirements of participating in this tour. The guest affirms that they are able to participate in the tour. The guest understands that, while participating, they may be walking for several hours, including on uneven walkways, sidewalks and roads. The guest agrees to inform Paris by Mouth of any food allergies and understand that not all requests can be accommodated given the nature of the tour. The guest understands that Paris by Mouth acts solely as an agent in arranging food tours, venue visits & other services. The guest understands that all of the guides are independent contractors of Paris by Mouth and have been selected based on their experience. Paris by Mouth is not responsible for the actions of, the conduct of or the decisions made by the guide.
Paris by Mouth is not liable for bodily injury or property damage as a result of (but not limited to): physical exertion for which a guest is not prepared; forces of nature; collisions with bicycles, pedestrians, or automobiles; road and sidewalk conditions; reactions or sickness from consumption of food or wine, consumption of alcoholic beverages; civil unrest; terrorism; lack of or limited access to medical attention or the adequacy of medical attention once provided.
The guest understands that Paris by Mouth reserves the right to take photographic or other images or records of any of its trips or events, and the guest hereby agrees that it may use any such images or records for promotional and/or commercial purposes, or approve such use by third parties with whom Paris by Mouth may engage, without any remuneration to me. The guest hereby consents to the use of their name, image, and/or likeness in connection with such photographic or other images in any territory, through any medium, and for any purpose and waives all claims to compensation therefor. The guest hereby assigns all right, title, and interest that they may have in or to any and all media in which my name, image and/or likeness might be used by Paris by Mouth.
The guest understands that Paris by Mouth reserves the right to refuse as a trip participant or remove from a trip any person, including those it judges to be incapable of meeting the physical rigors and requirements of participating in the trip, those it determines might detract from the enjoyment of the trip by others, or those who have engaged in conduct during such trip that is disruptive, unlawful, or otherwise unsuitable. No refund shall be given if asked to leave the tour. The guest agrees to follow all written and verbal rules of safety presented to me by Paris by Mouth or the leader/guide.
The guest hereby releases and holds harmless with respect to any and all injury, disability, death, or loss or damage to person or property, whether caused by negligence or otherwise, Big Mouth, LLC d/b/a Paris by Mouth, its employees, tour guides, subcontractors, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns (collectively Paris by Mouth). Furthermore, without limitation, Paris by Mouth is not responsible for any injury, loss, or damage to person or property, death, delay or inconvenience in connection with the provision of any goods or services occasioned by or resulting from, but not limited to, acts of God or force majeure, acts of war or civil unrest, insurrection or revolt, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking of tours, mechanical or other failure of any means of transportation. The guest agrees that this release shall be legally binding upon me personally, all members of my family and all minors traveling with me, my and their heirs, successors, assigns, and legal representatives, it being their intention fully to assume all the risks associated with this trip and to release Paris by Mouth from any and all liabilities to the maximum extent permitted by law.
